EVGA Associates Program 是一 EVGA 菁英會員的專屬計畫，菁英會員加入後可獲得一串由英文及數字組合而成的代碼，此 Associate Code 可提供給第三方 ( 買家 ) 於 EVGA Online 購買合格商品時使用，進而獲得公告百分比的折扣。訂單成立後，Elite Associate 將會收到訂單金額乘以公告百分比的 EVGA 回饋金。

台灣 EVGA Associates Program 始於 2021 年 8 月 30日

任何與 EVGA Associates Code 相關的機器人應用、垃圾郵件和相關騷擾，將導致該會員立刻失去 EVGA Associate Program 資格，並沒收所有累積的 EVGA Bucks，由 EVGA 保留最終裁量權。本條款適用範圍包括但不限於 EVGA.com 及其他第三方網站，無論該網站是否屬於 EVGA 所有。

網域擁有者、版主及其他用戶隨時可以向 SupportTW@evga.com 報告、檢舉任何不當濫用，我們的團隊將嚴格審查該類行為，請盡可能提供更多訊息以協助調查。

您必須擁有一個信譽良好的 EVGA 台灣帳戶 ( 可以透過 EVGA 台灣網站進行註冊 ) ，並遵守本頁的相關條款與條件。您可以拜訪本網址進行註冊：

- 包含台灣本島、澎湖、金門、馬祖等地區。
- 若你居住在 EVGA 台灣以外的適用地區 ( 美國、歐洲 ) 等地，則適用於當地的 Associates Program 條款及條件。

Associates 將不能使用個人 / 他人的 Associate Code 進行訂單折扣。

根據本條款及條件，Associate code 的使用將不會有次數限制，單一第三方買家使用次數亦不受限。

買家 – 成為買家

買家必須擁有 EVGA 台灣的帳號，該帳號將作為 EVGA 台灣線上購物的資格帳號。

買家必須購買合格產品列表上的產品，定義如下。
要透過 Associates Program 取得買家折扣，買家必須透過已知的 Associates 會員取得合格的 Associate Code，並在結帳時輸入。亦或是透過含有Associate Code cookie 的 Associate 超連結圖案進行購買。類似瀏覽器 Cookies 將自動保存 14 天或在訂單成立後自動抹除。
任何特殊情況或要求將由 EVGA 官方進行定義及處分。

根據本條款及條件，Associate code 的使用將不會有次數限制。

EVGA 及其子公司、母公司、代理商、經銷商及零售商的員工和管理人員，以及其親屬與同住人員，將沒有資格參加 Associates Program。

Associates Program 如何運作：

EVGA Associates Program 提供於 EVGA 台灣線上購物獲得折扣的機會，且讓您能獲得相對應百分比的 EVGA回饋金！

第一，分享您的 Associate Code 給有興趣購買 EVGA 產品的朋友。可以透過直接複製 Associate Code 分享，也可透過含有 Cookie 的超連結進入 EVGA 台灣進行選購。如果買家透過含有 Cookie的超連結進入 EVGA 台灣，該 Cookie 將存留在瀏覽器 14 天，並在結帳時自動帶入 Associate Code。

一但買家進入 EVGA 台灣官網，買家必須註冊一個免費的 EVGA 帳號 ( 如果該買家沒有 EVGA 帳號的話 )。接下來買家需要購買合格類型商品並成立訂單。訂單結帳時，必須確認 Associate Code 完整輸入才能得到指定折扣，而 Associates 會員也才會獲得 EVGA回饋金。接下來買家必須完成結帳成立訂單！

訂單完成後，EVGA Associate 會員將會收到買家產品購買金額指定百分比的 EVGA 回饋金。根據 Associates Program 條款及條件，若無任何取消訂單及退貨退款情事，EVGA 回饋金將在訂單日期後的 30 天歸戶。

EVGA 將提供 7 種產品類別供 Associates Program 使用，包含：

水冷散熱
- 包含 CLC 產品、HYBRID Kits 等…
顯示卡
- 不包含顯示卡周邊配件*
主機板
電源供應器
電競鍵盤
電競滑鼠
影音擷取盒

具有 DOA-Only 保固申告的 EVGA 產品將額外排除在合格產品類別之外。

EVGA 保留以任何時間、任何理由隨時新增 / 刪除合格產品的權利，恕不另行通知。EVGA 將盡力在發生變化前先行更新合格產品列表，但最新的 Associates 合格產品列表及百分比可以在 Associate 首頁及儀表板中查詢。

使用 Associate Code 的買家可以購買多項 EVGA 合格產品，且一次啟動所有折扣。購買多項產品的情況下，折扣百分比將自動帶入對應的產品類別。同樣的情況，Associate Code 也可以應用在 EVGA DIY Configurator 或 Bundle 優惠產品，訂單成立時也將依類別自動帶入折扣。( 目前 EVGA DIY Configurator 及 Bundle 優惠僅於 EVGA 美國官網服務，我們將盡速在台灣開啟相關計畫。 )

了解 Associates 儀表板：

EVGA Associates 會員可以在任何時間於儀錶板中檢視 Associate Code、EVGA 回饋金餘額、未歸戶 EVGA 回饋金、本月獲取的 EVGA 回饋金…等資訊。頁面下方將提供不同的分享選項，包括 Associate Code 超連結圖像。另外也可以檢視「菁英推薦分潤百分比」及「親友折扣百分比」。

Associate 回饋百分比圖表包含「菁英推薦分潤百分比」及「親友折扣百分比」

Associate 回饋百分比圖表是當買家以 Associate Code 進行購買時，該 Associate 會員能夠獲得的 EVGA 回饋金百分比。
- 所有 Associates 會員皆根據合格產品類別表，適用同樣的回饋百分比。
根據本條款及條件，EVGA 保留隨時更改、調整百分比的權利。

舉例來說，如果 Associates 回饋百分比為 1%，Associate 將收到該產品實際購買價格的 1%。

例：買家購買價值 NT$ 3,000 的商品
- Associate 回饋百分比為 1%，入帳當日匯率為 $1：NT$ 30
- 三十天後，Associate 會員將入帳 NT$ 3,000 的 1%等值 EVGA 回饋金。NT$ 3,000 x 1% = NT$ 30 ；NT$ 30 / 當日匯率 = $ 1 = 1 EVGA 回饋金。 ( 若無法整除則以四捨五入計算 )

「親友折扣百分比」圖表使 Associate 會員了解使用他們 Associate Code 的買家，結帳時將收到多少折扣，即使購買的商品符合當下的折價活動，仍可使用 Associate Code 進行折價。

「親友折扣百分比」是第三方買家在購買合格的 EVGA 產品並於結帳時使用 Associate Code 後所能立即獲得的折扣百分比。
- 無論何時使用任何人的 Associate Code，折扣的百分比皆相同，可參考公告的合格產品列表及百分比。
根據本條款及條件，EVGA 保留隨時更改、調整百分比的權利。

買家折扣兌換及條款：

買家代表使用 Associates 會員的 Associate Code 於 EVGA 台灣線上商城購買合格產品並結帳的客人。買家可以透過 Associates 會員取得折扣碼，或透過點選 Associate 超連結圖樣進入 EVGA 台灣消費。

買家折扣兌換：

為了使用 Associate Code 並取得折扣，買家必須遵循下列步驟：

註冊一個 EVGA 台灣的帳號。( 如果您沒有帳號的話，註冊是完全免費的。)
1. 註冊前請詳讀上方「資格」說明。
將合格產品加入購物車
有兩種方式取得買家折扣 - a) 點選 Associate 圖像超連結或 b.) 結帳流程時手動輸入 Associate Code
1. 點選 Associate 圖像超連結
  1. Associates 會員將會獲得一個圖像超連結，該超連結可提供任何人點選，點選後瀏覽器將會自動帶入 cookie 並存在 14 天。Cookie 將在結帳時自動填入該 Associate 會員的折扣碼。
    1. Cookie 將在在點選 Banner 後，成立訂單後自動過期，亦或是等待 14 天自動到期。
  2. 一但買家點選圖像超連結並取得 Cookie，即可繼續進行到結帳流程。
  3. 在結算金額頁面，您的折扣總額將顯示在「Associate Code 折扣」。
  4. 請繼續至第四步
2. 手動輸入 Associate Code：
  1. 結帳過程中，請先填寫需求資料、選擇運費方案，並接受物流的條款條件。
  2. 當你進入結算金額頁面時，輸入 Associate Code 並按下「APPLY」
  3. 買家折扣將立刻出現
持續進行付款流程並完成訂單。

買家折扣條款：

使用合格的 Associate Code 買家將在購買合格產品結算金額時獲得折扣。其中並沒有限制買家能使用的 Associate 次數，也沒有限制買家在同一訂單中能購買幾組合格產品。結帳金額將會扣除已知的商城折扣或任何活動價，才會乘上菁英分潤百分比。買家則無法折扣任何額外稅額、運費、地方稅款等款項。

如果買家折扣百分比在訂單成立後有所更動，EVGA 將保留權力自行調整金額。結帳時若無正確使用 Associate Code，將無法在訂單成立後進行調整。

一旦訂單完成，受限的訂單資訊將會在 Associates 會員中的動態頁面中條列顯示。該訂單資訊僅會顯示訂單日期及每個合格產品的購買金額。不會揭露任何其他訊息給 Associates 會員知曉，其他的訂單資訊將持續符合 EVGA 的隱私權政策，了解更多請拜訪此網頁：: https://tw.evga.com/privacy.asp

Associates 會員 EVGA 回饋金兌換及條款：

Associates 會員為加入 Associate Program 的 EVGA 菁英會員。Associates 會員將取得透過第三買家使用 Associate Code 在 EVGA 台灣官網購買合格產品後，獲取 EVGA 回饋金的能力。

EVGA 回饋金兌換：

Associates 會員將會在以下步驟中逐步獲取 EVGA 回饋金：

加入 Associates Program 後，每位新的 Associates 會員將會獲得一組獨一無二的 Associate Code。
只要在符合地區法律或網域規則的情況下，Associate 會員可以隨心所欲的分享 Associate Code 給任何意圖購買 EVGA 產品的買家。
1. 為了易於分享，Associates 會員可以使用預先植入程式碼的圖樣超連結。Associates 會員可將之分享至 EVGA 論壇或是社群網站。
為了獲取買家購買後的回饋，買家必須遵守上方的買家折扣條款。
1. 簡短來說，買家必須使用 Associates 會員的 Associate Code 完成合格產品的購買。
一但使用 Associate Code 的訂單完成，相關資訊將會顯示在您的 Associates 動態頁面。
1. Associates 會員在動態頁面可以取得：
  1. 透過該Associate Code，購買的每項合格產品的購買金額及購買日期。
  2. 未歸戶 EVGA 回饋金以及已獲取的 EVGA 回饋金
  3. EVGA 回饋金的歸戶日期
所有透過 Associate Code 購買的合格產品回饋金，需要等待 30 天，系統才會進行歸戶。以確保該訂單沒有退款、退貨等情況。
1. 一但等待期間結束，EVGA 回饋金將會自動入帳至您的 EVGA 帳號。

Associates 兌換條款：

當買家使用Associate Code 於EVGA 台灣購買合格產品後，該Associates 會員將會收到 EVGA 回饋金。為了計算應得的 EVGA 回饋金，對應的回饋百分比將乘上合格產品的最終小計金額，亦即扣除網站折扣、活動折扣、促銷定價的最終金額。Associates 會員分潤百分比在訂單成立的當下即會計算完成，無法事後調整。

每項透過 Associate Code 購買的合格產品、未入帳的 EVGA 回饋金以及預計的歸戶日期皆會在 Associate 的動態頁面中顯示。EVGA Associates 會員僅會在買家沒有取消訂單或退貨退款的情況下，於 30 天候入帳 EVGA 回饋金。針對 EVGA 回饋金並沒有其餘的替代方案，您將無法兌換成現金，除非未來 EVGA 有其他活動。

EVGA 保留因任何理由取消或暫停發放 EVGA 回饋金的權力，理由包括利用漏洞、詐欺或是足以破壞 Associates Program 等其他行為。

General Terms and Conditions for the Associates Program:

EVGA reserves the right to modify, suspend, or cancel the EVGA Associates Program at any time, for any reason, and without notice. EVGA reserves the right to add or remove EVGA Bucks acquired through the Associates Program at its own discretion at any time and without compensation to the Associates member. The EVGA Associates Program and benefits may not be used in any unlawful manner, for any unlawful purpose, or in any manner that violates any right of EVGA or prohibited by these Terms.

You may not transfer or assign EVGA Bucks to any other person or entity; Associates members can only earn EVGA Bucks for their own account on EVGA.com.

EVGA Associates Program membership is conditional upon being an EVGA ELITE member. If, for any reason, an Associates member's EVGA ELITE membership expires or terminates, the member will also be removed from the EVGA Associates Program. EVGA Associates may cancel their membership at any time through the EVGA Associates portal at EVGA.com. Former EVGA Associates members become ineligible to sign up again for the EVGA Associates Program at the time of the cancellation or termination of their Associates membership, except at the sole discretion of EVGA. If an EVGA Associate’s membership status is cancelled or terminated while EVGA Bucks are Pending, then the EVGA Bucks will be forfeited.

EVGA will not be responsible for any losses or damage suffered by Buyers or Associates members due to failure to complete any or all steps within the time limit provided at each step of the process. EVGA will not be responsible for any losses or damage suffered by an Associate if a participating Buyer or prospective Buyer fails to properly purchase a product using the Associates member's Associate Code.

Associates members are responsible for all federal, state, local taxes, fees, and any applicable withholdings and reporting requirements associated with acceptance and use of EVGA Bucks acquired via the EVGA Associates Program.

Privacy Data Usage for the Associates Program:

By agreeing to the EVGA Associates Program Terms and Conditions, you agree that EVGA may send you email and other communications related to your EVGA Associates membership, regardless of any settings or preferences related to your EVGA account. You will still have the option to disable email and communications not related to your Associates membership. In general, such emails may include, but are not limited to, information such as Associates Percentage changes, EVGA Bucks successfully added to your account, changes to the Buyer Percentage or other information regarding the status of your Associates Membership status.

Associates will receive limited data on pending EVGA Bucks on their Activity Page, which may include partial information of a third-party's purchase of a Qualifying Product. Providing this data to Associates members is for informational purposes only and does not grant any authority or agency over the transaction or the Buyer, nor does it grant express or implied authorization or a license to request information from EVGA regarding any third-party transaction used in conjunction with the Associates member's Associate Code.

With the exception of the stated usage of personal privacy data mentioned in these Terms and Conditions, all such data is handled strictly in accordance with EVGA's Privacy Policy, which can be located here: https://tw.evga.com/privacy.asp

Disclaimer

The EVGA Associates Program is provided as an optional program for registered accounts at EVGA.com, which contains a variety of benefits to Associates members. Registration is available to all EVGA ELITE members at EVGA.com who reside in a region serviced by an EVGA.com Store, with the exception of commercial accounts, such as businesses, organizations, and sole proprietors. Participants of the EVGA Associates Program agree to be bound by the Terms of the EVGA Associates Program, the Terms of the EVGA Bucks programs, and all other applicable EVGA terms and conditions. Failure to follow any of the Terms and Conditions may result in termination of your status as an EVGA Associates member.

EVGA reserves the right to terminate, without notice or compensation, the EVGA Associates Program in part or its entirety, and these Terms at any time. In the event of Associates Program membership termination, all restrictions, disclaimers, and limitations of liability set out in these Terms remain binding.

If any provision contained in these Terms is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions in these Terms, and the invalid, illegal, or unenforceable provision shall be deemed modified to have the most similar result that is valid and enforceable.

Limitation of Liability

IN NO EVENT SHALL EVGA OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE TO YOU OR TO ANY THIRD-PARTY CLAIMING THROUGH OR UNDER YOU, FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES. EVGA OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD-PARTY FOR SUCH DAMAGES, INCLUDING ANY LOST PROFITS ARISING FROM OR RELATING TO THE EVGA ASSOCIATES PROGRAM AND THESE TERMS. IN ALL CIRCUMSTANCES, EVGA'S MAXIMUM LIABILITY SHALL NOT EXCEED THE CASH AMOUNT EQUAL TO TWO TIMES THE NUMBER OF EVGA BUCKS EARNED BY AN ASSOCIATE IN THE 30 DAYS IMMEDIATELY PRECEDING THE DATE OF THE EVENT GIVING RISE TO SUCH LIABILITY. EVGA OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO MEMBERSHIP PROGRAM WHICH EXCEEDS THIS LIABILITY LIMIT. EVGA OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES SHALL NOT BE LIABLE FOR THIRD-PARTY CLAIMS FOR DAMAGES FOR DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, OR EXEMPLARY DAMAGES, WHETHER OR NOT EVGA HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
